Hi, I have a tenant who has not paid for 3 mnths now, the tenancy agreement we signed was to give 4 weeks notice (not 2 mnths). I believe i have to give her a notice to quit............firstly, wher do i get this notice? Secondly...........can i give her the 4 week notice as per our agreement, or do i have to give her two months? (what is a section 8?) cheers

See AST versus Licensing thread: I'm in a similar situation. I tried it on my own, but ultimately the tenant knew the law better than me, so I now have a brief do the paperwork.

I do not know what a section 8 is. I would have thought a simple section 21 (Housing act 1988 section 21 (4) (a) Notice requiring repossession ) on a AST would have been enough.

Make sure it hand-delivered by an independent agent or signed for... Also my brief said 8 weeks notice was acceptable if you wanted to ensure a win at court, if it came to it.

Thanks PO, i initially approached a lawyer and was quoted £95.00 per hour rising to £150.00 ph!!

I think I should try the section 21 initially but where do I obtain the form?

I believed it was eight weeks notice and for arrears of over eight weeks, however I spoke to a lady at the courts and she said either four weeks or eight depending on the agreement..........to be safe I think I should go with the eight weeks.

You try to do right for people..............

Contact the NLA (National Landlords ASsociation. They will have the section 21 and section 8 forms and all the advice you could hope for. Section 8 is for 14 days notice but involves court. Good luck

Hi PO,

Membership was worth it for me simply because I saved the membership fee in the reduction off my buildings insurance through Alan Boswell. They give you a reduced rate if your member of a landlords association. They have a help line to answer in queries you may have regarding tenancy law etc., but I dont use this much. In saying that it would be very helpful if you have problem tenants. They also send out a bi-monthly publication with latest news on the market, new regulations on HMO's and a variety of other useful info which is worth a read. The membership fee is low (at about £65 a year so in my view it is worth it.

we have been members of NLA for a couple of years and find them really helpful with eviction advice, would recommend them.

Brilliant advice, I joined, downloaded the forms and served my tenant notice on 4th August.(watch this space.) Jimmy, did you get insurance through RLA then?

I get all my insurance through Alan Boswell, which is discounted if your a member of a landlors association. You just ring them up and give them your NLA number. Cheapest I've found
