I think it is down to if the Council inspects a property that is found to be in substantial disrepair they may serve a notice on the person having control of the property, e.g. the landlord. Things that would constitute disrepair are:

A hole in the roof, perhaps a slipped slate Rotten window frames Leaking gutters Cracked render Crumbling brickwork Perished or crumbling wall plaster

but each coucnil may have their own interpretation.

Hope this helps

Cheers Russell. Just saw it on an estate agents website and thought I'd never heard of that before.

Do you think then that if this property was for sale, the current landlord would have to make good the repairs before he could sell it or is it possibly why the property is priced lower to take into account the repairs needed?

I think he can sell it as is - as long as he tells you everything that might be wrong with it to the best of his knowledge. I've seen places advertised with asbestos needing to be removed, so i guess anything goes!

It'd have to be in a pretty dreadful state for the council to get involved though. Also consider it might be your responsibility to temporarily house the tenants while work is carried out, so depending on their contract could be a liability.

cheers

John
