Hi, does anyone have any advice for dealing with an eviction? Our tenants want council housing but council need them to be evicted to be classed as homeless before they will provide housing. Any advice out there?

Why dont you write them a letter advising them that you are terminating their contract and they must leave by so and so date. If that isnt strong enough or you are still within the AST period you will need a reason for eviction e.g. rent arrears.

Yes - John is right - it will partly depend on how long they've been there on the AST, and you'll need 2 months notice to evict (is it a section 21 you need? I think so).

However, if it's in their interest to be evicted, you may be able to mutually anull the AST?

Have you tried Landlord Action (advertisment on the RHS of these pages) - they have a free advoce line which might be worth a call?

John
