Hi, we're about to sell our only property as we plan to emigrate. Has had tenants for 3 yrs while we live in parents in laws house. What should we do about the deposit? Pay it back to tenants and let new landlord request new deposit? Property currently not in satisfactory condition. Deco has been ruined, dirty etc. Can we claim any of deposit, we pressume not as tenants will not be vacating property. Any advice much appreciated!

Hi Gresha,

Deposit should be handled by solicitors upon completion of sale. Easiest thing to do is to deduct it from sale price and let purchaser know why.

Unfortunately you cannot calim any of the deposit back until the tenant vacates but if you have found a buyer who is happy with the property as it stands it shouldn't matter.
