Hi,

Two years ago I let a property to a single mother through the council via the Rent Deposit Scheme. All was going very well until the Housing Benefit stopped. I managed to sort out the rent but then the housing benefit was reduced. The tenant told me she could not afford to pay the balance of the rent so I served a section 21. What really annoyed me was that the council have instructed her to stay until the magistrates are involved. The council know she is not able to pay the balance of the rent yet they are advising her to break the law and stay in the property until evicted. Where is the justification?

this is common mate and very annoying, they will not rehouse her until the magistrates serve an order and all at your cost. This is what landlords are up against, Basically an unfair system for getting of ones ass and trying to better yourself. rise above it as there is plenty of unfairness in this buy to let game.

Total nightmare for us unfortunatley last time in front of magistrates they told me I had a social responsiblity being a landlord even though they had not paid rent for 3 mths.

A social responsibility! What about the tenant, do they have no responsibility? Plus how much does that cost!

Offer the tenant £350 to leave the property. This will save you a lot time and money. Offer them the money with condition that no money is handed over until the property is handed over in an ok clean state. Then get another tenant in and move on. I have done this a coupleof times and it has worked. Unless the tenant is a complete scumbag in which yes you will need to do the county court thing

Easiest way to deal with problem tenants in my experience is to threaten them, their children and their extended family. It's amazing how quickly they toe the line.

Am I the only one disturbed by DG's posting?

It is lunacy to come into a pulic forum and suggest that anyone should threaten a tenant, let alone children.

I hope I never have to rent from him.

DG - it could be you who is sued by the tenant for Harrassment - the courts don't like it and it could be more than just a fine for you if you practice what you preach.

Hello all,

Thanks for your comments very interesting! Anyway an update:

The local county court have written to my tennant instructing her to leave the property. She has then taken this to the housing department, and they have advised her to pay the rent or they will not rehouse her. So she has paid me some monies which is not bad. The process has been a little slow, but I have had no problems sleeping.

I am now waiting for the possesion date so hopefully I will get the rest of the rents.
